TM Geneseas Platform

1. Terms and Conditions of Use

1.1 Overview of the Platform

TM Geneseas is a comprehensive smartbox solution designed by Tototheo Maritime Ltd (hereinafter "Tototheo Global") to digitally transform maritime operations. The Platform provides role-based access to functionalities including dashboards, vessel monitoring, bandwidth management, firewall configuration, user services, and support.

1.2 Eligibility

Use is limited to individuals aged 18+, authorized vessel or company personnel, or corporate entities under agreement with Tototheo.

1.3 Role-Based Access

Depending on your user role, you may be granted access to one or more of the following modules:

  • Dashboard & Monitoring Tools
  • Fleet/Vessel Overview
  • User Management
  • Usage and Performance Reports
  • Support Ticketing & Troubleshooting Page

Tototheo grants tiered access to the Platform based on predefined user roles. These roles are determined during system onboarding and may be adjusted by your organization's designated administrator or by Tototheo upon request.

A. Crew-Facing Portal Use

Crew members may be granted access to a simplified interface including:

  • Personal usage statistics (bandwidth, browsing time)
  • Internet Café logins and balances
  • Crew Wi-Fi policies
  • Support/helpdesk requests specific to individual access
  • Personal profile management

Crew members may not:

  • View or modify vessel-level configurations
  • Access system-wide reports or firewall settings
  • Access or manage other user accounts

All crew activity is logged and monitored to ensure compliance with the vessel's digital use policies and Tototheo's Acceptable Use Policy.

B. Shore-Based User Access

Shore-based personnel (e.g., fleet managers, IT officers, company administrators) may be granted access to:

  • Fleet-wide dashboards and vessel diagnostics
  • Data usage reports per vessel or user group
  • Remote configuration of firewall, bandwidth shaping, or policy updates
  • User and role assignment
  • Escalated technical support tickets and history

Shore users are responsible for ensuring that usage and access align with internal IT and compliance policies of the managing entity. Sharing credentials is strictly prohibited.

C. Captain-Only Access

The vessel's captain may be granted elevated privileges to:

  • Approve/restrict onboard service configurations (e.g., crew internet access, bandwidth allocation)
  • Temporarily activate or suspend specific services onboard
  • Monitor user-level access logs and onboard connectivity
  • Review security alerts and firewall breaches
  • Access support communications for the vessel

Captains are entrusted with the operational security of the system onboard and must ensure compliance with relevant maritime IT safety protocols and shipowner directives.

Account Security

Each user must:

  • Use only authorized credentials
  • Maintain the confidentiality of their login information
  • Promptly report any suspected unauthorized access or breach

Tototheo is not liable for loss or damage resulting from the misuse of credentials or negligent account management.

1.4 Permitted Use

Users may access the Platform solely for operational, support, or crew welfare functions related to maritime service. You agree to:

  • Use the Platform only for its intended maritime operational purposes
  • Comply with vessel policies and Tototheo's Acceptable Use Policy
  • Not interfere with system integrity or attempt unauthorized access to restricted areas

1.5 Restrictions

Users must not misuse the Platform, introduce malware, bypass security controls, access unauthorized areas, or overload the network. The Platform must not be used to:

  • Transmit unlawful, harmful, or obscene content
  • Engage in unauthorized peer-to-peer or streaming activity that disrupts vessel bandwidth
  • Circumvent firewalls or security controls

1.6 Security & Availability

Tototheo strives for continuous uptime. Access may be limited due to scheduled maintenance, satellite issues, or emergency updates. Tototheo endeavors to ensure 24/7 uptime but cannot guarantee uninterrupted access due to:

  • Scheduled maintenance or firmware updates
  • Satellite connectivity issues
  • Emergency service suspensions for security reasons

In such cases, Tototheo will notify shore-based contacts via the support portal or designated email.

1.7 Intellectual Property

All rights to the Platform, TM Geneseas system software, visual elements, and trademarks remain with Tototheo Global. You are granted a limited, non-exclusive, non-transferable license to use the Platform as per your role and access permissions.

1.8 Amendments

Tototheo reserves the right to modify these Terms. Material updates will be communicated via the Platform and/or email. Continued use after such notice implies acceptance of the changes.

1.9 Support Services

All users have access to the Support page on the Platform. Features may include:

  • Ticket submission (categorized by urgency)
  • User-specific FAQs
  • Documentation and guides
  • Chat or email support channels

Support availability may vary depending on your service agreement or vessel location.

1.10 Limitation of Liability

To the fullest extent permitted by law, Tototheo Global and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the Platform. This includes, but is not limited to, loss of profits, loss of data, loss of business opportunity, system interruptions, degraded connectivity, or hardware failures resulting from improper configuration or unauthorized use.

In no event shall Tototheo's total liability under these Terms—whether in contract, tort (including negligence), or otherwise—exceed the amount actually paid by your organization for access to TM Geneseas services during the twelve (12) months preceding the event giving rise to the claim. This limitation applies even if Tototheo has been advised of the possibility of such damages.

Tototheo shall not be responsible for failures or disruptions caused by satellite network outages, power interruptions, vessel misconfiguration, unauthorized third-party access, or any use of the Platform that violates the Terms or relevant vessel policies. Furthermore, Tototheo shall not be liable for service failures or delays caused by force majeure events, including but not limited to extreme weather conditions, natural disasters, armed conflict, piracy, labor strikes, or governmental restrictions.

The Platform is not certified or intended for use in life-critical or safety-critical systems, including vessel navigation, propulsion, or emergency signaling. You acknowledge and agree that the Platform is provided as a supplementary tool and not as a substitute for core maritime operational systems.

1.11 Termination

Tototheo may suspend or terminate access for any user who:

  • Violates these Terms
  • Poses a security threat
  • Fails to comply with licensing or operational agreements

Termination may apply to individual users or entire vessel accounts depending on the severity of the breach.

Governing Law

These Terms are governed by the laws of the Republic of Cyprus, with exclusive jurisdiction in the Republic of Cyprus.

2. Privacy Policy

Tototheo Global ("Tototheo", "we", "us", or "our") is committed to protecting your personal data and ensuring transparency in how we collect, use, store, and share information when you use the TM Geneseas Platform (the "Platform"). This Privacy Policy explains what data we collect, how we use it, your rights, and how to contact us.

This Policy applies to all users of the TM Geneseas Platform, including crew members, captains, shore-based staff, and vessel operators.

2.1 Who We Are

Tototheo Global is a provider of maritime communication and technology services. Our TM Geneseas Platform supports onboard smartbox systems that enhance vessel operations, communication, and digital services. Our headquarters are located at 89 Omonoias Avenue, Limassol. 2.2 What Data We Collect

Depending on your role and level of access, we may collect the following types of data:

a) User Data

  • Full name, rank or role, user ID
  • Email address and contact details (if provided)
  • Login credentials (hashed passwords, tokens)
  • Access logs and user activity timestamps

b) Device & Technical Data

  • IP and MAC addresses
  • Browser or device type
  • Operating system version
  • Network identifiers and session information

c) Platform Usage Data

  • Bandwidth consumption
  • Websites or services accessed (where enabled)
  • Login durations and terminal usage (e.g., Internet Café sessions)
  • Crew internet quota balances (if applicable)

d) Operational Vessel Data

  • Vessel name, IMO number, and system ID
  • Firewall events, data routing, and diagnostics
  • Logs from the TM Geneseas smartbox and connected devices

We do not knowingly collect sensitive personal data unless required by law or expressly provided by the user.

2.3 Purpose of Processing

We process your data to:

  • Provide access to and functionality of the Platform
  • Authenticate users and manage permissions
  • Monitor and secure the network and system operations
  • Enable shore-based administrators to manage vessel configurations
  • Track and allocate bandwidth consumption
  • Provide crew internet services and usage insights
  • Respond to support requests and troubleshoot issues
  • Comply with legal and maritime regulatory obligations

2.4 Legal Basis

We rely on the following legal grounds for processing personal data:

  • Contractual necessity: to provide access to the Platform and its features
  • Legitimate interests: ensuring secure and efficient vessel operation and platform optimization
  • Legal obligations: where required by maritime authorities or applicable law
  • Consent: for optional services

3. Acceptable Use Policy

3.1 Scope

This Acceptable Use Policy ("AUP") governs all use of the TM Geneseas Platform and related network services provided by Tototheo Global. It applies to all users, including crew members, captains, shore-based personnel, system administrators, and any third parties granted access.

3.2 Prohibited Activities

You must not use the Platform to:

Engage in unlawful, harmful, or fraudulent activities, including:

  • Accessing or distributing child exploitation materials
  • Infringing intellectual property or third-party rights
  • Defrauding, impersonating, or misleading others

Disrupt, damage, or interfere with system performance, such as:

  • Introducing malware, viruses, or denial-of-service attacks
  • Circumventing firewall rules or bandwidth restrictions
  • Attempting unauthorized access to administrative or restricted modules

Engage in excessive or abusive personal internet use, including:

  • Using crew internet services for file-sharing (P2P, torrents)
  • Continuous streaming or large downloads that disrupt bandwidth availability
  • Operating hidden proxies, VPNs, or tunneling services onboard

Violate vessel policies or shore-side employer rules, including:

  • Sharing access credentials with unauthorized individuals
  • Misusing monitoring or surveillance features beyond approved scope
  • Accessing confidential crew or business data without clearance

Transmit or store offensive or inappropriate content, such as:

  • Harassment, discrimination, or hate speech
  • Pornographic or violent material not permitted by shipowner or flag state
  • Content likely to cause moral or disciplinary concern aboard

3.3 Responsibilities

Each user is responsible for:

  • Maintaining the security and confidentiality of their credentials
  • Logging out after each session (where applicable)
  • Using shared services fairly and without impeding others
  • Reporting suspected misuse, cyber risks, or compromised accounts

Captains and administrators are responsible for enforcing proper access levels and maintaining compliance onboard, in collaboration with Tototheo where needed.

3.4 Monitoring and Enforcement

Tototheo and/or your employer or shipowner may monitor Platform activity as necessary to:

  • Enforce this AUP and system rules
  • Investigate potential misuse or violations
  • Maintain cybersecurity and ensure system performance
  • Comply with legal or regulatory obligations

Monitoring is carried out in a proportionate manner and in accordance with applicable privacy laws. Crew members will be informed through onboard notices or this Platform if monitoring tools are active.

3.5 Consequences of Violation

Violations of this Policy may result in any of the following actions:

  • Warning or advisory notice
  • Suspension or restriction of access
  • Revocation of Platform privileges
  • Internal disciplinary action by the shipowner/operator
  • Reporting to maritime authorities or law enforcement, where applicable

Tototheo reserves the right to take all necessary technical and legal steps to protect the Platform and other users from harm or misuse.

3.6 Amendments

This AUP may be updated periodically to reflect technical, operational, or legal changes. Users will be notified of material updates via the Platform or vessel administrator. Continued use of the Platform after an update constitutes acceptance.
